Our photgrapher mailed to me the new edition of "the knot" (not released yet) and had a paged marked and THERE WE WERE!!! It is an add for colleges.net and it features one pic from Michael Anthony. Amazing huh? We will be signing books in the malls soon. hahhahahahah

and this is the picture they used bigger.....

Everyone that was a part of our day I cant thank enough for making it so perfect...so nearly a year later..thank you and we love you...

Ok, so an update on the whole scammer/photographer- broke me….

I went to the bank the day after wrote the last entry because when icalled BOA and they told me to. I went to the branch where the dirtbag cashed my “stale” check. Let me note that EVERYONE in the bank branch thinks that I should get my money back and that they want my business more than his because he is obviously shady. Well, they cant by law give me my money from his account. He waited till the stop payment lifted and the personal check technically doesn’t expire so if they took his money back, he could sue them. The tellers all thought the check was “stale” but when they called the corporate/securtity division they were informed differently.

So in college I worked for a set of lawyers. Some personal injury , workmans comp, and contract law….Well if I have learned anything, I have learned, that opinions are like assholes, everyone has one.

Out of 5 different friends of ours that are attorney’s ; One of them informed me that I don’t have the 72 hour rule at all and proceeded to tell my husband that we will have to pay for this guys legal fees if we sue him…its on the lovely contract that I signed. 3 of them told me that I have the 72 hour rule to get out of the contract; and 1 of them (the contract attorney) told me that he thinks that there is a rule but I’ll have to do some research…but I definitely can use the mitigate his damage rule…i ask “what is mitigate my damages?”

It is …A person is not allowed to stand by idle and watch further harm come to his/her property. Everyone must use reasonable care and diligence to minimize the damages - to do what s/he can to prevent additional damage. An injured party must make a reasonable effort or expend reasonable costs to prevent the amount of loss or harm from increasing. For example, if constant rain is raising the level of a lake next to your home, you have the responsibility to take steps to prevent damage from the flood which is about to occur, such as moving property to higher ground or putting out sand bags to prevent water from entering your home. The particular acts required by a person to mitigate damages is determined on a case-by-case basis. It is set as what is "reasonable" under the particular circumstances.

So basically he cant take my money for no reason. He is allowed to have a cancellation rule and a set $ amount but he isn’t aloud to keep 1300.00 of mine for having a contract for a few hours. What are his damages? Any judge will tell him that he is shady by holding my check for 13 months before cashing it and have no contact with me at all and my contact is cancelling the contract by return receipt. Even if I made a bad/premature call to sign the contract, any judge will see that I did my part to cancel it and the guy is blatantly try to scam me.

So Monday I will go fill a claim in small claims court. And I will win….hahahhahaha. im predicting..

I want to put on all websites my story…he is not nice. But I have been so busy with work so I haven’t yet, but I really really want to.

This is my story of something very mean and devious that is going on as of yesterday. I am writing this in my LJ and linking the blog to website that I am filing a complaint with….

On 6/21/06 I went to a new photographer because mine was so expensive and we had to cut our cost somewhere and this website had some awesome pics. I made an appt and Jess, my MOH, and I went.

We met Eric Wayne, the owner of Amazing Photography and Video, Inc. He told us all about how he has had this amazing business for years and that his now ex wife was trying to take it all and that is why he had to relocate to Tamarac from Weston. He told us stories how his wife kidnapped his son when he was days old and how there was this ongoing battle in court. Him and his wife did IVF to get pregnant right when they got married. I don’t know why they did it right away but they did.

Anyway, he was trying to be so nice to Jess and I....he invited us to a Tony Braxton concert that night. He was in a hurry because he had to go. So I hurriedly signed the contracts and gave him two checks. One for $683.00 and the other for $400.00 for the deposit.

I get home and tell Gary that I have done this and he is upset that I signed a contract and he hasn’t ever seen his work or met him. So I immediately call his phone which he didn’t answer because he was at the concert. I typed up a letter and I faxed it along with the contracts I signed. I know about the cooling off rule and what goes along with it and that it has to be in writing and all that. So I went and sent the same letter too him within 24 hours with a return receipt. I got the receipt back showing that he got the letter on 6/26/06. It was mailed on 6/23/06. I also contacted Bank of America to put a stop payment on the checks on 6/22/06.

Well we got married and I kept my original photographer per my husband’s request. I thought the issue was over and then 07/18/07 happened. I signed on my bank account on BOA and I was negative almost $700.00, I don’t know how this is possible. I never overdraft. I am instantly sick. I look and think immediately that someone has stolen my checks and written them to themselves. I call BOA and the gentleman informs me that the stop payment is only good for about a year and that my letter they mailed me said so. He also told me something I didn’t know…that checks don’t expire unless you write on them to. So now the check doesn’t expire but the cancelling of the check does? The guy then tells me that he is very sorry but he cant assist me anymore and that I should contact an attorney. I explain that it will cost me so much to hire an attorney. He said well we need to get your account in good standings. I told him I don’t have $700.00 lying around my house. I am beyond frustrated. How is this fair? So we hang up and call Wayne who did this.

He is very cool and collected on the phone. I calmly tell him what happened. He tells me that he had every right to deposit my check. The contract says non refundable deposits. I tell him that I am not a mean and devious person and that I can’t believe that I met him and heard all about his child and wife and had so much compassion and that now you would do this to me. He says “I can tell how much you cared, your screwing me” I asked how was a screwing him. I already had a contract with another photographer when I came to him. He told me that they had to give me the $ back and not to worry. I told him that once I got home and my soon to be husband was upset that’s why a cancelled…not to screw him. I said if you were getting married and you were in the same situation wouldn’t you do the same thing? He told me he would have to call me back once he looked at my contract. I said you won’t call me; you’ll just dodge my phone calls. He is like, fine I have caller ID- I have your number. I said, I’m not afraid to give you my number I just don’t think you will use it. I told him that my attorney told me I had 72 hours to cancel the contract in writing and he said no. He said sue me……I’LL WIN! I was so upset.

I called the bank again and this time they are putting in a claim for this issue. Not only are the checks over a year old, but I did put a stop payment on them. Also, he never performed a service for me. He said he held the date, but I have proof with the return receipt that he received notice that I cancelled the contract. I also filed a complaint with the fraud department….because this is clearly fraud. He cashed my checks over a year later.

Hi Eric,

I got home and reviewed my contracts with Gary and he was frustrated that I signed 2 contracts without him for OUR wedding. He is completely right and I would like to cancel the contracts and reschedule an appointment so that Gary can see your work and be as impressed I was.

So therefore, take this as notice to cancel the following attached contracts that I signed a few hours ago. The videography for the amount of $1400.00 and the photography for the amount of $2590.00.

Please also fax me a copy of the 2 checks (one for the amount of $400.00 for the videography and one for the amount of $863.33 for the photography) with void written across them.

I am so sorry that I rushed into signing these contracts and wrote out check to you, without speaking to Gary first. I just got caught up in the moment of your pictures and us rushing so that we could get to our prior engagements as well as you to your concert.
I will call in the morning to make an appointment to come in with Gary to show him your work next week, because he isn’t off work till Thursday of next week.
